The petitioner is apprehending his arrest in connection with Derni P.S. Case No. 22 of 2016 for the offences instituted under Sections 147, 148, 149, 323,341, 307,353, 332, 427 and 109 of the IPC.
The prosecution story, in brief, is that the informant received information that a Tempo carrying passengers fell down in the river. The informant sent other police personnels there and with the help of others pulled out the said Tempo from the river and taken the said Tempo into the police station. The villagers wanted not to take the Tempo in the police station and started snatching forcibly from the police station. Co-accused Guddu
Patna High Court Cr.Misc. No.627 of 2017 (2) dt.11-01-2017 2/3 Sharma was arrested upon which FIR named accused including the petitioner together with 100-120 unknown forcibly got released Guddu Sharma from the police custody. The petitioner and others broken tables, chairs and also pelted stones on the police.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. He has falsely been implicated in the present case. General and omnibus allegation has been made against him. No specific overt act has been alleged against him. The other co-accused have been granted anticipatory bail by another co-ordinate Benches of this Court vide Annexure-2 series to the present application. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Derni P.S. Case No. 22/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-VIIth, Saran at Chapra, subject to the conditions
