It has been submitted that parentage of these petitioners has been wrongly typed as Ram Ekbal Singh whereas the correct name of the parentage is late Ram Sakal Singh. The counsel for the petitioners seeks permission to correct the parentage name of these petitioners.
Permission is granted.
Let necessary correction be made in the course of the day.
The petitioners apprehend their arrest in Karghar (Barhari) (O.P.) P.S. Case No. 238 of 2016 instituted for the offence under Sections 341, 323, 504, 506, 307, 324/34 of the
Patna High Court Cr.Misc. No.1405 of 2017 (2) dt.16-01-2017 2/3 Indian Penal Code.
It is alleged that on the date of occurrence the brother of the informant, namely, Hareram Singh caught hold him and accused Raghuwar Singh armed with Kudal and accused Devraj Singh armed with lathi assaulted on his head, causing cut and bleeding injury. The injury report has been enclosed as Annexure-2 wherein the doctor has found one stitched wound on the right parietal region of head about 4" in length, caused by hard blunt substance, simple in nature.
From the written report itself, it appears that occurrence has taken place on account of land dispute. It is alleged that Raghuwar Singh and Devraj Singh assaulted with Kudal and lathi on the head. The doctor has found only one injury on the head of the injured. It is not clear from the written report that who has caused that injury and also not specifically alleged in the written report. In the circumstances, prayer of the petitioners for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Karghar (Barhari) (O.P.) P.S. Case No. 238 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like
Patna High Court Cr.Misc. No.1405 of 2017 (2) dt.16-01-2017 3/3 amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, subject to the conditions as laid down under Section 438(2) Cr.P.C.
