The Petitioners apprehend their arrest in Aurangabad Muffasil P.S. Case No.62 of 2016 instituted for the offence under Section(s) 341, 323, 324, 308, 325/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Aurangabad.

There is allegation in the written report that while informant along with his friend was going to house on motorcycle, in the way, these petitioners armed with iron rod restrained them and assaulted them causing injuries on fore-head and other parts of the body and both became senseless. The accused persons wanted to snatch the motorcycle. The villagers

Patna High Court Cr.Misc. No.5012 of 2017 (3) dt.07-03-2017 2/2 brought them to Sadar Hospital, Aurangabad, for treatment. Case diary has been received.

The learned APP has submitted that Injury Report of both the injured are mentioned in para 54 and 55 of the case diary. Opinion with regard to injury of Rakesh Roushan was kept reserved, while injury on the person of Vicky Kumar was found to be grievous.

In view of such, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
