The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 34 of the Indian Penal Code, section 7 of the EC Act and section 53 of the Disaster Management Act, 2005.

As per the prosecution case, 37 quintals rice in SFC Jute bags was seized by the villagers who disclosed that the same was purchased by the accused persons from the PDS shop of the petitioner for black marketing.

Learned counsel for the petitioner denies the allegation and submits there is noting on the record to show that the said rice had been purchased or lifted from the PDS shop of the petitioner. However, during pendency of the case, his

Patna High Court CR. MISC. No.137 of 2022(3) dt.28-04-2022 2/2 dealership has also been cancelled. Petitioner has claimed clean antecedent and he is in custody since 15.7.2021. Investigation is complete.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Bikramganj, Rohtas in Karakat Police Station Case No. 79 of 2020.
