JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 31-01-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kishanganj P.S. Case no. 49 of 2016, registered under Sections 341, 323, 307 and 498(A)/34 of the Indian Penal Code. The accusation is of torturing of the informant by her husband (Petitioner) due to non-fulfillment of demand of dowry and also due to illicit relation of husband (petitioner) with other girl. Learned counsel for the petitioner submits that there is one male child, aged about 10 years, out of their wedlock. Further submission is that petitioner is ready to keep the informant as a wife with full dignity, but informant is not ready to live with the petitioner

Patna High Court Cr.Misc. No.2109 of 2017 (2) dt.31-01-2017 2/2 as appeared from the order dated 02.11.2016 passed in A.B.P. No. 394 of 2016 by the Sessions Judge, Kishanganj.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No. 49 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
