The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. Allegation against this petitioner is of commission of assault by lathi to the informant and his cousin sister. It is submitted that injuries attributed to this petitioner is found to be simple in nature. Due to land dispute between the parties the alleged occurrence took place. There is general and omnibus allegation and no specific overt act has been alleged against this petitioner.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court

Patna High Court CR. MISC. No.72286 of 2021(4) dt.10-11-2022 2/2 below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 454 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
