2. The petitioner has preferred this application for grant of regular bail in connection with Warisaliganj P.S. Case No. 336/2025 dated 24.06.2025 registered for the offence punishable u/ss 319(2), 318(4), 338, 336(3), 340(2), 61(2), 111(4) read with Section 3(5) of the B.N.S. and Section 66B and 66D of the I.T. Act.
3. As per the prosecution case, police got a secret information that some miscreants indulged in cyber crime are assembled near Baghi field who are cheating innocent people through mobile phone. Thereafter, police raided the said place then on seeing police 22-24 persons started fleeing away but

No.60733 of 2025(3) dt.17-11-2025 2/3 nine persons were apprehended, who disclosed their names as, Sudhanshu Patel, Vicky Kumar, Rajesh Kumar (petitioner), Sudhir Kumar, Gautam Kumar, Arvind Pandit, Mantu Kumar, Suraj Kumar and Santosh Kumar. On search, one mobile phone was recovered from the possession of the petitioner.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The charge-sheet has been submitted against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 25.06.2025. The co-accused person has already been granted regular bail by this Court vide order dated 25.08.2025 passed in Cr. Misc. No. 60062 of 2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Nawada in connection with Warisaliganj P.S. Case
Patna High Court CR. MISC. No.60733 of 2025(3) dt.17-11-2025 3/3 No. 336/2025, with the conditions:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date (except on the date of examination which is to be held on 29.08.2025), failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
