The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 447, 341, 323, 307, 379, 504, 506 and 34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he asked the accused persons not to plough the disputed land on which the present occurrence took place and the accused persons assaulted the side of the informant and with respect to the present petitioner it is alleged that he assaulted Ram Balak Yadav by lathi causing injury on his left hand. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, it is

No.71985 of 2021(2) dt.02-08-2022 2/2 next submitted that even presuming what has been alleged is true, without admitting for the purposes of anticipatory bail, then also the allegation of assault is by lathi on non-vital part of the body and admittedly there is a land dispute between the parties and from the side of the petitioner also one complaint case has been filed by one Ramvati Devi.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Trial Court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor court in connection with Lakhisarai (Ramgarh Chouk) P.S. Case No. 470 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
