JUSTICE BIRENDRA KUMAR ORAL ORDER 07-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code. Allegation against the petitioner is to have caused injury with khanti at the head of the aunt of the informant. Submission of the petitioner is that the doctor has not found any cut injury rather injury caused by hard and blunt substance which is simple in nature. Further submission is that there is a case and counter case between the parties. Since the petitioner had knowledge that his act might cause death, I am not inclined to enlarge the petitioner on bail.

Patna High Court Cr.Misc. No.4039 of 2017 (3) dt.07-04-2017 Accordingly, his prayer for anticipatory bail in connection with Manjhi P.S. Case No.207 of 2016 pending in the court of learned A.C.J.M.-V, Saran at Chhapra is rejected.
