Petitioner apprehends arrest in connection with Chanpatiya (Kumarbagh O.P.) P.S. Case No. 346 of 2022 registered for the offence under sections 356/376 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. As a matter of fact, the leg of the petitioner was fractured and in this regard petitioner was treated by Dr. Rajesh Kumar on 05.07.2022 whereas the present occurrence is of 13.07.2022. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.61477 of 2022(4) dt.18-05-2023 2/2 and the submissions advanced on behalf of the parties, the petitioner, above named, is directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate Bettiah, West Champaran in connection with Chanpatia (Kumarbag O.P.) P.S. Case No. 346 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
