The petitioner, who is in custody, seeks bail in connection with Sri Nagar (Pujaha) P.S. case No. 60 of 2016 instituted under Section 47, 50(c) of the Bihar Excise Amendment Act.

The allegation, in brief, is that 90 bottles of foreign liquor each containing 180 ml was recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that joint seizure list was prepared showing recovery from two accused and the co-accused Brijlal Mukhiya has been granted bail vide order dated 10.01.2017 passed in Criminal Miscellaneous No. 250 of

Patna High Court Cr.Misc. No.1932 of 2017 (3) dt.08-02-2017 2/2 2017 by a co-ordinate bench of this Court.

Considering the aforementioned facts and circumstances, the petitioner, named above is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Bettiah, West Champaran in connection with Sri Nagar (Pujaha) P.S. case No. 60 of 2016.
