JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2017 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with Jadopur P.S. Case No. 74 of 2016/ G.R. No. 3191 of 2016 for the offences punishable under sections 147, 148, 149, 323, 379, 353, 153 A, 295 A, 435, 504, 506 and 307 of the I.P.C.
Allegedly, people of Sri Ram Sena made a rumor that the police has left the meat smuggler after taking bribe and blocked the road and made obstruction by creating the situation of religious feeling and further obstructed the police in doing their
Patna High Court Cr.Misc. No.2761 of 2017 (3) dt.17-02-2017 2/2 duty. They also snatched the golden chain from the neck of the A.S.I. and accordingly 23 named and 200 unknown persons have been made accused in this case.
Submission is of false implication and that there is no specific allegation against the petitioners, the allegations are omnibus and general in nature, identification of the petitioners is also doubtful, now peace is restored between both the communities and the police only to save his skin has lodged this false case.
The learned A.P.P. opposes prayer for pre-arrest bail of the petitioners.
In the facts and circumstances as stated above, considering that there is general and omnibus allegations against 23 named and 200 unknown accused persons and as such the petitioners, in case of their arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. A.C.J.M- XIV, Gopalganj in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
