2. The petitioner seeks bail in connection with Bibhutinagar P.S. Case No. 60 of 2003 registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner alongwith other co-accused shot at the victim causing his death.

4. It has been submitted by learned counsel for the petitioner that no witnesses have been examined against other co-accused who are facing trial. It has been undertaken by learned counsel for the petitioner that the petitioner will cooperate in the trial and the charge has been framed.

5. Learned APP appearing for the State opposes the

Patna High Court CR. MISC. No.64644 of 2024(2) dt.01-10-2024 2/2 prayer for regular bail of the petitioner.

6. The petitioner is in jail since 18.05.2024 in a case of murder. The main accused of the case are Nando Mahto and Bandhu Mahto.

7. Considering the aforesaid facts as also the fact that the prosecution is not taking in conclusion of the trial, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Rosera, Samastipur in connection with Bibhutinagar P.S. Case No. 60 of 2003, subject to the condition that one of the bailors shall be the close blood relative of the petitioner.

8. The trial of the petitioner shall be clubbed alongwith the pending trial i.e. S.T. No. 11 of 2007/291 of 2015. (Sandeep Kumar, J) kiran/- U T
