The Petitioner apprehends his arrest in Abadpur P.S. Case No.100 of 2016 instituted for the offence under Section(s) 323, 341, 307, 504, 506, 379/34 Indian Penal Code. It is alleged in the First Information Report that on the date of occurrence the petitioner along with other accused was removing soil from the land of the Informant and on objection raised by the Informant, this petitioner assaulted her on head due to which she sustained injury.
Injury Report of the Informant has been annexed as Annexure-2, wherein, the doctor has found one lacerated wound over scalp 11⁄2" x 1⁄4" x 1⁄4" caused by hard and blunt substance. Opinion was reserved.
Patna High Court Cr.Misc. No.1621 of 2017 (2) dt.19-01-2017 2/2 It appears from the written report that the occurrence took place on account of land dispute between the parties.
In the circumstances, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Abadpur P.S. Case No.100 of 2016, he shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st class, Katihar, subject to the conditions as laid down under Section 438(2) Cr.
