The Petitioner apprehends her arrest in Pipra Kothi P.S. Case No.153 of 2016 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
It has been submitted on behalf of the petitioner that the husband is already in custody. The petitioner is the mother-inlaw and there is omnibus and general allegation against her in the written report.
As per the written report, daughter of the informant was married with Prem Lal Sah @ Khushilal. She was done to death by her husband and other family members. The petitioner is
Patna High Court Cr.Misc. No.1414 of 2017 (3) dt.10-02-2017 2/2 the mother-in-law of the deceased and there is no specific overt act against her.
The learned APP has pointed that in the Post Mortem Examination Report cause of death was said to be strangulation.
In the facts and circumstances of the case, prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Pipra Kothi P.S. Case No.153 of 2016, she shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) Cr. P. C.
