The petitioner seeks bail in connection with Kochas P. S. Case No.201 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2-18.

The learned counsel for the petitioner submits that the petitioner is in custody since 07.10.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 231.840 litre of liquor from a pick-up van.

The learned counsel for the petitioner submits that petitioner was arrested based on the confessional statement of Ravish Kumar and thus, not arrested from the spot.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in the case and his name came in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise, Rohtas in connection with Kochas P. S. Case No.201 of 2021.

The application stands allowed.
