2. The petitioner is seeking regular bail in connection with Pipra P.S. Case No. 206 of 2024 for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act 2022.
3. Allegedly, 243.6 liters of Nepali liquor was recovered from a vehicle of which the petitioner was driver.
4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is under custody since 22.06.2024.
5. On the other hand, the learned APP has opposed the prayer for bail and submitted that the petitioner is an accused in two other cases of similar nature and as such, he is a
Patna High Court CR. MISC. No.65483 of 2024(3) dt.07-10-2024 2/2 habitual offender.
6. Considering the above-mentioned facts and circumstances, the petitioner has two criminal antecedents of similar nature, I do not think it to be a fit case for bail, which is hereby rejected.
7. However, the petitioner, if so advised, may renew his prayer for bail after three months.
