The petitioner apprehends her arrest in connection with Nardiganj P.S. Case no. 17 of 2016, registered under Section 420 and 406 of the Indian Penal Code. The accusation is that in the light of Memo No. 285, dated 03.02.2016 of the District Programme Officer, Nawada, documents and folder in respect to appointment of Panchayat Teacher was to be supplied till 15.02.2016, but the same was not supplied by Panchayat Mukhiya Handiya, Kahuara, Pesh and Ichua etc.

Learned counsel for the petitioner submits that, in fact, vide letter dated 15.02.2016, Block Education Officer, Nardiganj, demanded the document of file folders regarding

Patna High Court CR. MISC. No.57592 of 2019(2) dt.11-09-2019 2/2 appointment of Panchayat teachers from Panchayat Secretaries of Nardiganj Circle in the light of Memo No. 285, dated 03.02.2016 not from the Mukhiya of the Panchayat. The petitioner is the Mukhiya of Ichuakarna Gram Panchayat. Further submission is that similarly situated co-accused Pramod Kumar, Mukhiya of Nardiganj has already allowed privilege of pre-arrest bail by a co-ordinate Bench of this Court on 11.06.2019 vide Criminal Miscellaneous No. 36455 of 2019.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.1st Class, Nawada in connection with Nardiganj P.S. Case No. 17 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
