JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Complaint Case no. 461 of 2018 registered for the offences punishable under Sections 323 and 498A of the Indian Penal Code.

Petitioner no. 1 is husband and petitioner no. 2 is dewar of complainant.

The dispute of the parties has been sent to Mediation Centre, Patna High Court, Patna and the learned Mediator

Patna High Court CR. MISC. No.58108 of 2019(5) dt.05-03-2020 2/2 reported that parties have settled their dispute by mutual consent and executed an agreement on 13.12.2019.

Learned counsels of the respective parties accepted this fact that the parties have settled their dispute amicably. In view of the aforesaid submission, the above named petitioners in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 2nd class Bikramganj, Rohtas in Complaint Case No. 461 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.

However, it is made clear that if any party violates the terms and conditions of agreement dated 13.12.2019, the other party will have right to take legal recourse. (Hemant Kumar Srivastava, J) N.K/- U
