The petitioner apprehends his arrest in a case registered for the offence under Section 394 of the Indian Penal Code.

As per F.I.R., on the point of pistol, the motorcycle of the informant was looted away by three unknown persons. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Rupesh Kumar Yadav.

It is submitted on behalf of petitioner that looted motorcycle has not been recovered from the possession of the petitioner, rather it was recovered in an abandoned condition near the bank of river and mere on confessional statement, this petitioner has been made accused. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.72429 of 2021(2) dt.20-07-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Jhanjharpur, District - Madhubani in connection with Phulparas P.S. Case No. 367 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
