JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 24-08-2015 The petitioner submits that he is the owner of the Tractor bearing registration no. BR 05A 3674 and its trailer. Pursuant to an agreement, he had lent his tractor and trailer for distribution of food-grains under Mid Day Meal in the schools. The petitioner is neither a P.D.S. Dealer nor food-grain was seized from his house.

2. In this view of the matter, the impugned orders, so far as it relates to Confiscation of the Tractor bearing registration no. BR 05A 3674 and its trailer is set aside. The Tractor and Trailer would be released in favour of the petitioner on furnishing adequate security subject to result of the criminal proceeding.
