Petitioner seeks bail in Siwan Town P.S. Case No.547 of 2018, registered under Sections 399 and 402/34 of the Indian Penal Code as well as under Sections 25(1-b) (a)/26/35 of the Arms Act.

Police raided a school on information that many criminals had assembled there to commit crime and three persons were arrested. The apprehended accused disclosed the name of the petitioner who managed to flee away. Learned counsel for the petitioner submits that the petitioner was not arrested on the spot and nothing has been recovered from possession of the petitioner. Petitioner is only an accused in one criminal case, i.e., Siwan Town P.S. Case No.181 of 2018, registered under Sections 379 and 411 of the Indian

Patna High Court Cr.Misc. No.75281 of 2018(2) dt.17-12-2018 2/2 Penal Code. There is no other criminal case pending against the petitioner. Petitioner is in jail since 15.09.2018 and he has already remained in jail for more than three months. Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Siwan Town P.S.
