The petitioner seeks bail in a case registered under Sections 147, 148, 149, 307, 324, 435, 436, 302, 379, 427 of the Indian Penal Code and 27 of the Arms Act. The prosecution case in brief is that a mob of 45 named and 100-120 unknown persons surrounded the village in question and set ablaze the houses of some villagers and indiscriminate firing was also made as a result of which, three persons died.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 23-07-2019. Charge sheet has

Altogether 45 persons are named in the FIR along with 100-120 unknown persons. General and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-V, Muzaffarpur in connection with Sessions Trial No. 163 of 2019 arising out of Paroo P.S. Case No. 89 of 1997 .
