JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Mednichowki P.S. Case No. 14 of 2015 registered for the offence under Sections 341, 323, 379, 420 and 504/34 of the Indian Penal Code.

It is alleged that the petitioner received Rs.1,30,000/- from the informant on the pretext of providing job in the Railway. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in this case due to village politics. He further submitted that the petitioner never received any amount from the informant. He also submitted that the informant sent a legal notice dated 30.08.2014 (Annexure-2) to the

Patna High Court Cr.Misc. No.2235 of 2017 (3) dt.13-02-2017 petitioner in which he has not stated that he has given Rs.1,30,000/- to the petitioner on the pretext of providing job in the Railway.

Considering the aforesaid facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Mednichowki P.S. Case No. 14 of 2015, subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
