The petitioners seek anticipatory bail in a case instituted for the offence under Sections 341, 323, 354, 504 and 506/34 of the Indian Penal Code.
It has been submitted that both these petitioners are nephew of the informant. There is land dispute between the parties. There is general and omnibus allegation against them. From the written report it appears that general and omnibus allegation has been levelled against the petitioners. It is alleged that they entered into courtyard and attempted to misbehave with her and on protest they assaulted the informant. The petitioners have annexed the final judgment and decree
Patna High Court Cr.Misc. No.3631 of 2017 (2) dt.10-02-2017 2/2 passed in Title Suit No. 33 of 2009 annexed as Annexure-2 to substantiate that there is land dispute between the parties. It is mentioned in paragraph-3 that the petitioners have clean antecedent.
Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Muffasil P.S. Case No. 91 of 2015, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Munger, subject to the conditions as laid down under Section 438 (2) Cr.
