2. The petitioner has preferred this application for grant of regular bail in connection with Bikramganj P.S. Case No. 267/2024 dated 05.05.2024 of the offences punishable u/ss 341, 323, 504 and 498A of the Indian Penal Code And Section 37 of the Bihar Prohibition and Excise Act.

3. Earlier the petitioner was granted provisional bail vide order dated 30.09.2024 and learned counsel for the petitioner seeks confirmation of the provisional bail granted to the petitioner.

4. As per the prosecution case, the petitioner and the

Patna High Court CR. MISC. No.68031 of 2024(3) dt.17-12-2024 2/2 co-accused persons are alleged to have tortured the informant mentally and physically due to non-fulfillment of demand of 2 katha land as dowry. Further, on 04.05.2024, the petitioner came to his house, in drunken condition, and started abusing and assaulting her.

5. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner who is husband of the informant. The petitioner neither demanded any dowry nor tortured the informant. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 05.05.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts, the provisional bail granted to the petitioner vide order dated 30.09.2024 is hereby confirmed in connection with Bikramganj P.S. Case No. 267/2024 to the satisfaction of learned Court concerned, Rohtas at Sasaram.

7. The application stands allowed.
