The petitioners seek anticipatory bail in a case instituted for the offence under Sections 341, 323, 325, 379, 504 and 34 of the Indian Penal Code.

It has been submitted that besides the offence under Section 379 Indian Penal Code, all the Sections are bailable. There is omnibus allegation against the petitioners that they snatched golden ear rings and jitia from possession of the mother of the informant.

From the written report itself, it appears that there is general and omnibus allegation against the petitioners. Besides

Patna High Court Cr.Misc. No.3109 of 2017 (2) dt.31-01-2017 2/2 this, there is no allegation of overt act against these petitioners. Considering the facts and circumstances of the case, let the petitioners above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Dulhin Bazar P.S. Case No. 123 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Danapur, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
