The petitioner apprehends his arrest in connection with Wazirganj P.S. Case no. 371 of 2018, registered under Section 302/34 of the Indian Penal Code.
The accusation is that in the morning of 21.11.2018, wife of informant Raghunandan Chauhan was preparing tea in her kitchen. At that time, Vikram Chauhan son of Rajendra Chauhan (petitioner), brother of the informant, came near his wife and started abusing his wife. When wife of informant made protest then Vikram Chauhan along with his mother and sister started pelting stones and bricks in which Saru Devi, wife of informant, sustained injury and died. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.57951 of 2019(2) dt.16-09-2019 2/2 petitioner is the own brother of the informant and he has falsely been implicated in this case due to grudge and enmity. Further submission is that specific allegation of pelting stone and bricks is against Vikram Chauhan son of the petitioner and due to that reason, the petitioner has also been implicated in this case. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-Ist Gaya in connection with Wazirganj P.S. Case No. 371 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
