JUSTICE SANJAY PRIYA ORAL ORDER 13-02-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks anticipatory bail in a case instituted for the offence under Sections 272, 273, 420 of the Indian Penal Code and Sections 47(a), (G) of Bihar Excise Act (new).

It has been submitted that the petitioner's name transpired on the basis of the statement of Chowkidar. The petitioner is said to be the owner of the car which met with an accident. The foreign liquor was recovered from the aforesaid car. It has further been submitted that co-accused Hiraman Sah @ Hiraman Jaiswal has been granted anticipatory bail by a coordinate Bench of this Court vide order dated 17.1.2017 passed in Cr. Misc. 558 of 2017.

It is alleged in the written report that Chowkidar told

Patna High Court Cr.Misc. No.4421 of 2017 (2) dt.13-02-2017 2/2 that the petitioner and the co-accused were seated in the aforesaid car.

Considering the facts and circumstances of the case, let the petitioner above named in the event of surrender within six weeks from the date of receipt of this order, in connection with Bhorey P.S. Case No. 97 of 2016, shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
