JUSTICE ARUN KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Sonbarsa Raj P.S.Case No.179 of 2015 corresponding to G.R.No.2763 of 2015 registered for the offences under Sections 147, 148, 149, 323, 324, 308, 504 and 506 of the I.P.C.

Allegation is that the petitioners, due to land dispute, have assaulted the informant.

Learned counsel for the petitioners submits that there is a case and counter case and alleged disputed land in a

Patna High Court Cr.Misc. No.9127 of 2017 (4) dt.22-03-2017 2/2 proceeding was found in favour of the petitioners' side and all injuries are simple except one injury on the hand is not on the vital part of the body and the petitioners have got no criminal antecedent except one case against petitioner no.1 under Sections 420, 467, 468 and 120(B) of the Indian Penal Code. Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Saharsa, in Sonbarsa Raj P.S.Case No.179/15 corresponding to G.R.No.2763/ 15, subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
