The petitioners apprehend their arrest in a case registered for the offence under Sections 363, 366(A) of the Indian Penal Code.

It is submitted on behalf of petitioners that specific accusation of kidnapping is against co-accused Santosh Sah. The victim, in her statement recorded under Section 164 Cr.P.C., has categorically stated that out of her own sweat will, she solemnised marriage with co-accused Santosh Sah. So far as these petitioners are concerned, they have been made accused merely because they happen to be distant relative of co-accused Santosh Sah. Petitioners claim clean antecedent.

Patna High Court CR. MISC. No.64061 of 2022(3) dt.05-07-2023 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge VI cum Special Judge (POCSO Act), Sitamarhi in connection with Runisaidpur P.S.
