This application is for grant of anticipatory bail in connection with Durgawati P.S.Case No.30 of 2006 for the offence under Sections 302/34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the only allegation against the petitioner is that he was armed with 'Lathi' and there is no other allegation against the petitioner. However, the petitioner has candidly accepted that this is a case of the year, 2006 and as he has not appeared in the case, he has been declared absconder in this case.

Heard learned A.P.P. also.

Having heard both sides. In view of the facts as stated

Patna High Court Cr.Misc. No.4285 of 2017 (2) dt.09-02-2017 2/2 above, I am not inclined to grant anticipatory bail to the petitioner, as such let the petitioner surrender before the learned court below, who will consider all aspect of the matter and will dispose of the application, if any filed by the petitioner.

With the aforesaid observation, this application is dismissed.
