JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner has filed the instant application for grant of regular bail in connection with Mansoorchak P.S. Case No. 26 of 2022 registered under Sections 341, 323, 325, 354(B), 379, 308, 452 and 34 of the Indian Penal Code. Allegation against the petitioner along with three other co-accused persons is that they suddenly trespassed the house of the informant and tried to outrage her modesty, and when she opposed, then they assaulted her due to which she sustained injury on both hands. It is further alleged that they broke the lock of the almirah and took some golden ornaments and Rs. 10,000/- and fled away.

He has falsely been implicated in this case due to previous enmity. It is further submitted general and omnibus allegation of assault has been levelled against the petitioner, nothing specific allegation attributed against the petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. He is languishing in judicial custody since 04.08.2022.

The application for bail is vehemently opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Mansoorchak P.S. Case No. 26 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st , Begusarai.
