The petitioners apprehend their arrest in Nawada Nagar P.S. Case No. 283 of 2021, registered for the offences punishable under Sections 419, 420 and 120 B of the Indian Penal Code.

As per the FIR, petitioner no. 1 and 2 sold the land of informant's share to the petitioner no. 4 of which petitioner nos. 3 and 5 are witnesses.

Patna High Court CR. MISC. No.72423 of 2021(3) dt.22-08-2022 2/2 It is submitted that this case is out and out civil dispute. Both parties are Gotia and co-sharers and one title suit is pending between the parties. Petitioners claim clean antecedents.

However, counsel for informant vehemently opposed the prayer for bail and submitted that petitioners have fraudulently registered the land of informant's share in favour of petitioner no. 4.

Considering the facts aforesaid and the fact that dispute is of civil nature, the petitioners above-named, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada (Nagar) P.S. Case No. 283 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
