The petitioner is apprehending his arrest in connection with Muffasil P.S.Case no.305 of 2014 , registered for offences punishable under Sections 147, 148, 149, 323, 224, 225, 353 of the Indian Penal Code.
Allegation as per FIR is that when the police went to nab the co-accused Ranjit Yadav, the petitioner and several other accused persons got Ranjit Yadav freed and also assaulted the police party.
Submission of the learned counsel for the petitioner is that though the petitioner is named in the FIR but nothing specific has been attributed against him. 03 named persons and 29 unknown persons have been made accused in this case.
Patna High Court Cr.Misc. No.77682 of 2018(2) dt.02-01-2019 2/2 Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Begusarai in connection with Muffasil P.S.Case no.305 of 2014, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure. With the aforesaid observation, this application is allowed.
