Singh, learned senior counsel for the petitioner assisted by Mr. Ravi Bhardwaj and learned Additional Public Prosecutor for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 406, 420, 467, 469, 120B of the Indian Penal Code.
3. The allegation in the first information report is that the petitioner, who is the proprietor of a company named Exito One, allured the informant, the proprietor of V.K. Enterprises that he would supply sponge iron in lieu of which the informant even deposited an amount of Rs. 8,42,520/- in the account of Exito One by RTGS mode which was subsequently transferred
Patna High Court CR. MISC. No.61282 of 2025(3) dt.15-11-2025 2/3 to the personal account of the petitioner and the said consignment was also not sent and the petitioner absconded.

Learned senior counsel for the petitioner, at the outset, submits that the entire case has arisen out of business transaction between the parties and as a matter of fact, the petitioner had supplied the material vide transport challan no. 18 of 2003, the document of which has been annexed as Annexure2 series to the present application. It has also been submitted that the delivery had been made in the presence of Shashi Kumar Mishra who is a staff of the informant and no objection certificate was issued in this regard. It has further been submitted that for a dispute which is totally civil in nature, the petitioner is languishing in custody since 17.04.2025, the charge-sheet has already been submitted and the cognizance has been taken.
5. Learned APP for the State and the learned counsel for the informant have opposed the application for bail to the petitioner on the grounds mentioned in the first information report.
6. Taking into consideration the facts and circumstances and also considering the fact that the matter relates to business transaction between the parties and at best

No.61282 of 2025(3) dt.15-11-2025 3/3 non-performance of an agreement by the petitioner essentially having a civil tenor, coupled with the fact that the petitioner has already remained in custody since 17.04.2025 and the chargesheet has already been submitted, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bypass P.S. Case No. 366 of 2021, subject to the condition that the petitioner shall cooperate in the trial and if it is found that the petitioner is not cooperating in the trial or any delay is being caused on account of his actions, the learned court below would be at liberty to cancel his bail bonds.
