The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 365 and 120B of the Indian Penal Code.

Co-accused Jasmina Khatoon had lodged Complaint Case No. 2453 of 2016 under Section 498A Indian Penal Code against husband and other in-laws including the informant of this case, who is father-in-law of Jasmina Khatoon. The petitioner is co-villager. In the aforesaid background, allegation is that the petitioner was involved in missing of the son of the informant. Submission is that just to pressurize, for withdrawal of the case under Section 498A Indian Penal Code, the present false case has been lodged.

No.3059 of 2017 (3) dt.02-03-2017 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar/Successor Court in connection with Azamnagar Police Station Case No. 115 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as subject to the condition that the petitioner shall fully cooperate with the investigation of the case and shall make himself available to the police for interrogation as and when required.
