JUSTICE BIRENDRA KUMAR ORAL ORDER 20-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 324, 307 and 435 of the Indian Penal Code and Sections 25(1-B)a, 26 and 27 of the Arms Act.

The petitioner allegedly caused injury with Farsa at the head of Rajdeo Kamat.

Submission of the petitioner is that the doctor has not found Farsa injury, rather injury found was simple in nature. Considering the fact that the petitioner had knowledge that his act might cause death, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer

Patna High Court Cr.Misc. No.7661 of 2017 (5) dt.20-04-2017 for anticipatory bail in connection with Phulparas P.S. Case No.115 of 2015 pending in the court of learned S.D.J.M., Jhanjharpur, Madhubani is refused.

However, the prayer for regular bail of the petitioner shall be considered on its own merits without being prejudiced by the present order.
