2. The present application has been filed for quashing of entire proceeding including the order dated 12/09/2008 passed by learned Chief Judicial Magistrate, Banka by which cognizance under Section 7 of the E.C. Act and Sections 406, 409 of the Indian Penal Code in Katoria P.S. Case No. 104/2008 has been taken against the petitioners and further this case has been referred to the court of learned S.D.J.M., Banka for trial and disposal and further directed to issue summons to the petitioners.
3. As the trial has started, learned counsel for the petitioners has very fairly submitted that the case may be
Patna High Court CR. MISC. No.12374 of 2017(2) dt.20-09-2023 2/2 disposed of but some time limit may be fixed.
4. The trial court is directed to conclude the trial within a year from the date of receipt/production of copy of this order.
