The petitioner is in custody in connection with Sessions Trial No. 481 of 2018 (arising out of Garkha P.S. Case No. 284 of 2016) for the offences under Sections 341, 323, 324, 307, 354, 504, 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner is in custody since 07.06.2017. He further submits that on account of previous enmity petitioner has been falsely implicated in this case. He referred to Derni P.S. Case No. 15 of 2016 which was registered against the brother of the informant and Garkha P.S. Case No. 112 of 2014 which was registered against the father of the informant.

Considering the fact that there is previous enmity on

No.57463 of 2019(2) dt.13-09-2019 2/2 account of the case registered against the father and brother of the informant and the fact that the petitioner is in custody since 07.06.2017, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Additional Session Judge-X, Saran at Chapra in connection with Sessions Trial No. 481 of 2018 (arising out of Garkha P.S. Case No. 284 of 2016), subject to condition that petitioner shall extend full cooperation in the Trial and if he fails to attend the Court proceeding on two consecutive dates without any cogent reason, the Court below shall be at liberty to cancel the bail bond of the petitioner.
