JUSTICE MUNGESHWAR SAHOO ORAL ORDER 01-02-2016 The petitioner wife has filed this writ application under Article 227 of the Constitution of India for setting aside the order dated 04.06.2014 passed by Family Court, Patna in Matrimonial Case No.879 of 2013 whereby the Court below directed the husband-respondent to pay Rs.2,000 only per month and Rs.5,000 as cost of the litigation and prayed that the monthly maintenance be enhanced to Rs.10,000 per month and the litigation cost may be enhanced to Rs.10,000 from Rs.5,000.

From perusal of the impugned order dated 04.06.2014, it appears that the Court below after considering the income of the husband-respondent and thereafter calculating the same allowed the application filed by the wife-petitioner and directed as stated above to the respondent.

In such view of the matter, this Court cannot exercise appellate or revisional jurisdiction to enhance either the

Patna High Court CWJC No.18356 of 2014 (2) dt.01-02-2016 maintenance per month or the litigation cost. Accordingly, this writ application is dismissed. (Mungeshwar Sahoo, J) Saurabh/- U T
