JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 07-03-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Hisua P.S. Case No. 144 of 2016 for the offences punishable under sections 420, 467 and 468 of the I.P.C.

Allegedly, the petitioner and other co-accused without administrative approval and only on the basis of technical approval executed the work of earth filling and in that work instead of using man power they used machine power against the requirement of Manrega scheme and as such defalcated the money. Further they tampered the record after showing the work cancelled.

Patna High Court Cr.Misc. No.2146 of 2017 (4) dt.07-03-2017 2/2 Submission is of false implication, as a matter of fact no work was done at all as the scheme was itself not sanctioned, no money has been withdrawn by the petitioner or any of the coaccused, similarly situated co-accused Anil Kumar has been allowed pre-arrest bail vide Cr. Misc. No. 49691 of 2016 by another co-ordinate Bench of this Court and as such the petitioner also deserves sympathetic consideration.

The learned A.P.P. opposes prayer for pre-arrest bail of the petitioner, but fairly submits that the co-accused Anil Kumar has been allowed pre-arrest bail.

In the facts and circumstances as stated above, the petitioner, in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. C.J.M. Nawada in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
