2. The petitioner seeks bail in a case registered for offence under Sections 302, 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
3. The case of the prosecution, in brief, is that on 20.08.2023 at about 1 PM, the F.I.R. named accused persons came and took brother of the informant along with them on the pretext of purchasing a mobile phone and on the same day in the evening, the informant received an information that his younger brother has been murdered by gun shot.
4. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation on the basis of confessional statement of co-accused Nitish Kumar. However, it is the specific case of the informant that the F.I.R. named accused persons took away brother of the informant and
Patna High Court CR. MISC. No.60076 of 2025(2) dt.17-10-2025 2/2 killed him. Similarly situated co-accused has been granted bail by this Court, vide order dated 25.10.2024 passed in Cr.Misc. No. 54990 of 2024. Petitioner is in custody since 22.03.2025.
5. Learned A.P.P. for the State opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, Manjhaul, Begusasrai in connection with S.T. No. 467 of 2025, arising out of Khodawandpur P.S. Case No. 245 of 2023.
