JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-02-2017 The petitioners are in custody since 22.09.2016 in connection with Chakai P.S. Case No. 26 of 2012, registered for offences punishable under Sections 368, 370, 371/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that they have been made accused in this case only because they happens to be the cousin of the main accused of this case and except that there is nothing against them so as to show their involvement in the present case and they have been in judicial custody since 22.09.2016.

Heard learned A.P.P. also.

Having heard both sides, considering the aforementioned facts and circumstances, the period of custody and also that the petitioners have no criminal antecedent, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000

Patna High Court Cr.Misc. No.607 of 2017 (3) dt.17-02-2017 2/2 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Chakai P.S. Case No. 26 of 2012, subject to the following conditions;- (i) One of the bailors of the petitiones shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioners will not induce any witness or tamper with the evidence.

(iii) The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court and on the event of failure on their part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
