2. The petitioner seeks regular bail in connection with Alipur P.S. Case No. 45 of 2023, lodged on 10.04.2023, under Section 393 of the Indian Penal Code and under Section 37 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution case, FIR has been lodged against two named accused persons including the petitioner. In the FIR, it has been alleged by the informant that two persons have attempted to snatch his motorcycle but upon his resistance one accused has been caught on the place of occurrence and another accused fled away. The arrested accused disclosed the name of the petitioner.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.67359 of 2023(2) dt.17-10-2023 2/2 petitioner is innocent and has committed nothing. He submits that nothing has been recovered from the possession of the petitioner nor he was put on Test Identification Parade. Counsel submits that he is in custody since 02.08.2023. He submits that there are three criminal cases pending against the petitioner and in all cases he is on bail.
5. Learned counsel for the State opposes the prayer for bail and submits that the petitioner has three criminal antecedents.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Hence, the application for bail of the petitioner is hereby rejected but liberty is granted to the petitioner that he may renew his prayer for bail after framing of the charges.
