The petitioner seeks bail in a case registered under Sections 363, 366A/34 of the Indian Penal Code and Section 8 of POCSO Act and 83(2) of Juvenile Justice Act. Allegation is that the accused persons including the petitioner kidnapped the daughter of the informant for the purpose of ill motive.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 26.05.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The victim has been recovered and her statement has been recorded under Section 164 of Cr.P.C. There
Patna High Court CR. MISC. No.57421 of 2019(2) dt.11-09-2019 2/2 is no allegation of physical or sexual assault against the petitioner. The main allegation is against co-accused Pankaj Mandal.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District and Sessions Judge-cum-Special Judge (POCSO), Bhagalpur in connection with Special case POCSO No.03 of 2019 arising out of Nathnagar P.S. case No.28 of 2019.
