The petitioner apprehends his arrest in connection with Baunsi P.S. Case No. 262 of 2018, registered under Sections 376, 493/34 of the Indian Penal Code, pending in the court of the learned Chief Judicial Magistrate, Banka. The accusation is that petitioner entered in the house of informant and committed rape. On raising alarm, her parents and villagers reached there then petitioner assured to perform marriage with the informant, while she conceived pregnancy due to rape by the petitioner and when proposal was made to perform marriage then on the instruction of parents of the petitioner, he left the village.

Having considered the facts and circumstances of

Patna High Court CR. MISC. No.57594 of 2019(2) dt.11-09-2019 2/2 the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
