Petitioner is seeking anticipatory bail in connection with Bihta P.S. Case No. 554 of 2017 registered for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is a co-villager of the informant. In the case of theft said to have been committed in the house of the informant the name of the petitioner has transpired on the basis of the confessional statement of the co-accused, but there is neither any cogent evidence to connect him with this case nor any incriminating article has been recovered from his possession or his house. Learned counsel further submits that the petitioner is
Patna High Court Cr.Misc. No.76197 of 2018(2) dt.21-12-2018 2/2 ready and willing to cooperate with the investigation. Learned APP for the State is present and has opposed the prayer for bail.
Considering the facts and circumstances of the case where it is found that till date nothing has been recovered from the house of the petitioner, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned A.C.J.M., Danapur in connection with Bihta P.S. Case No. 554 of 2017, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond. This will be in addition to condition prescribed under Section 438(2) of the Cr.P.C.
