The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 498(A), 304(B)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

As per prosecution case, the informant alleged that the petitioner along with his family members used to torture the informant's daughter and demand of land and due to nonfulfillment of dowry demand, his daughter has been killed by them.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is elder brother of the husband of the deceased due to

It is further submitted that the marriage of the deceased was solemnized with coaccused Raj Kumar Singh, about ten years earlier and the petitioner has no concern mess and business of the deceased as well as her husband. It is further submitted that the petitioner is languishing in judicial custody since 29.7.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Udwant Nagar P.S. Case No. 277 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bhojpur at Ara.
