JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 24-04-2017 After some arguments, learned counsel for the appellants seeks permission to withdraw the instant appeal to enable the appellants to surrender before the learned court below. Accordingly, the instant memo of appeal is dismissed as withdrawn with a liberty to the appellants to surrender before the learned court below and while considering the prayer for regular bail, the learned lower court will consider the theme of land dispute as well as privilege envisaged under Section 41 of Code of Criminal Procedure which the appellants enjoyed during course of investigation without being influenced by the instant order.
